eBus On Demand App and Privacy Policy

Terms used in this Privacy Policy have the same definition as in our eBus on Demand Terms and Conditions of Use , which set out the terms and conditions for the Services and the use of the App and Website.

This Privacy Policy explains what personal information will be collected when a User engages with the APP or the Website and how:

  • it will be stored
  • it will be used;
  • it will be disclosed; and
  • the User can correct or change it.

By submitting personal information to the App, Nelson City Council’s contact centre or any driver of a Vehicle, you confirm that you have understood and agree to this Privacy Policy.

We reserve the right to amend this Privacy Policy at any time. If we do so, we will alert Users of the amendment by email and/or in-App messages (unless the User has chosen to opt-out of these forms of communication). By continuing to use the App or the Website, you confirm that you have understood and agree to the amendments.

Personal Information Collected

We collect the personal information entered into the App, provided via telephone to Nelson City Council’s contact centre or provided to the driver of a Vehicle by Users. This includes name, e-mail address and accessibility requirements . A User may also elect to provide their phone number. Certain functionality within the App or the Website may depend on the provision of additional information from time to time, such as location information (and adjusting the settings of your device to turn location services on). The driver of a Vehicle may directly collect any further or missing personal information from Users necessary to provide the Services.

The provision of any of the abovementioned personal information is not mandatory, but a failure to do so may restrict the Services available or otherwise affect the functionality of the App or the Website for a User.

Statistical information is gathered automatically when you use the App. This includes User-specific behaviours, such as how far in advance they book, times they would book, when and how they cancel Trips and the ways the Services are used (App Statistics).

When you interact with the Website, certain information is recorded in the Website log files, which may include:

  • the top level domain name from which you access the internet;
  • the IP address of the computer from which you access the Website;
  • the date and time each computer accesses the Website;
  • the pages accessed and the documents downloaded by each computer;
  • the type and version of the browsers being used to access the Website;
  • the addresses of any third party webpages which refer visitors to our Website;
  • keywords used in search engines and directories to find the Website; and
  • keywords and phrases used to search the Website.

Occasionally, we may conduct surveys to understand better the needs of Users in order to improve the App and/or the Website. The provision of any information in response to a survey is voluntary and we will never share this information with any third party without Users’ express consent.

The information and data from Services may be used to generate anonymized and aggregated statistical and analytical data and be used for the Associated Parties’ internal research and product development purposes and to conduct statistical analysis and identify trends and insights. In addition, the Associated Parties’ may supply the aggregated statistical and analytical data to third parties following our written consent.

Storage of Personal Information

Personal information provided is stored by us, and also on our behalf by an Associated Party Liftango Pty Ltd (Liftango) on AWS cloud servers hosted in Sydney, Australia. Your privacy is a high priority for us, and the Privacy Act 2020 (Privacy Act) applies to all personal information held by Nelson City Council and contractors who hold personal information on our behalf (whether in New Zealand or overseas) . For backup purposes, copies of personal information, in-App messages and subscriber lists are also stored by Liftango in decentralised secure servers in Australia.

The App also stores some personal information on your device. It is your responsibility to ensure that the security features of your device are sufficient for your needs. This personal information will be deleted when the App is uninstalled from your device.

We may retain all personal information that we collected for as long is as necessary for us to carry out the purposes for which the information was collected, including the provisions of Services to you as a User. An archive of Website Log Files and associated analysis and reports are retained indefinitely by us as a way of measuring patterns of website traffic over the years and inorder to facilitate future planning.

Use of Personal Information

We (and our Associated Parties) use the abovementioned personal information to:

  • provide you with the Services (including the provision to you of email and/or in-App notifications regarding the Services) and administer your account;
  • provide you with notification of changes to the App, this Privacy Policy, the Terms and Conditions of Use and/or the Services;
  • deal with your requests, enquiries or complaints and other User care related activities; and
  • improve the App, the Website and the Services.

App Statistics are used at an aggregate, anonymised level for Associated Parties to carry out analysis for the Services as a concept. They are also used to facilitate the optimisation of parameters for the Services.

Website Log Files are used for statistical purposes only, including to:

  • find out how many people are visiting the website;
  • identify what pages are accessed most frequently;
  • help us improve the information we are supplying to our users; and
  • make our site more user friendly.

Disclosure of Personal Information

In addition to any other disclosure provided by this Privacy Policy, your personal information will only be disclosed to our staff and Associated Parties to the extent necessary to provide you with the Services.

The extent of your personal information disclosed to any driver of a Vehicle is limited to your first name, last name, email address and accessibility requirements. Additionally, any notes which you have chosen to add to a Booking request are visible to drivers.

We may also release your information when we believe release is appropriate and in compliance with the Privacy Act (including disclosure to relevant law enforcement agencies).

We will not otherwise sell, trade, or otherwise transfer to outside parties your personal information.

Your Right of Access to Personal Information

You have the ability to update and correct via the App the personal information that is connected to your account.

You also have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you would like to ask for a copy of your information, or to have it corrected, please contact us at  ebus@ncc.govt.nz or 03 546 0200.
